张惟越 | 为何不成立联合管理机构?

2013年分层管理法令规定:要办第一次成立管理机构的年会需得先达成该共管楼宇25%业主的转名手续,因许多业主并未事前准备好这一大笔金额的印花税,迟迟不完成它,导致该楼宇的转换率无法达到法令最低要求的25%。

有读者私信,新家入伙至今已经超过13个月了,为何发展商迟迟不举办年会成立联合管理机构(joint management body)呢?

按照2013年分层管理法令,第17条文(1)(b)表示当房产从交房日(领钥匙)算起,发展商得在不超过12个月的期限举办第一次年会并成立联合管理机构。

法律原文:

Section 17 Establishment of a Joint Management Body

(1) A joint management body shall be established upon the convening of the first annual general meeting of that joint management body –

  • (b) if vacant possession is delivered after the commencement of this Act, not later than twelve months from the date of delivery of vacant possession of a parcel to a purchaser.

故,许多业主的理解就是得成立联合管理机构,但是,当我们细读法令,在第17条文的第五附条文明确提到,如果管理机构(Management Corporation)文书在第一次成立联合管理机构的年会举办前出生(成立),那成立联合管理机构就无必要了。

Section 17 Establishment of a Joint Management Body

(5) If the management corporation comes into existence before the first annual meeting of the joint management body specified in subsection (1) is convened –

  • (a) the first annual general meeting shall not be required to be convened and no joint management body shall be established for that development area;

所以,拥有官方地契文件(Strata Book)的共管楼宇无需召开成立联合管理机构的第一次年会,可直接越过成立联合管理机构,并直接成立管理机构。
